Abstract

Law 13.964/2019 (Anti-Crime Law) expanded the areas of consensus in the Brazilian Criminal Proceeding and has instituted the legal institute of the agreement of noncriminal prosecution in art. 28-A of the Criminal Procedure Code. Unlike previous decriminalizing institutes, brought in the first dimensions of consensual justice in Brazil, the NPA has its own contours and assumptions, which are examined in this essay. It is a bilateral legal deal, a space of consensus between the prosecution and the investigated, which accepts a reduced sanction proposal in exchange for not being formally accused.
