Abstract

This study deals with one of the recent changes in criminal legislation as a result of the anti-crime measures: the maximum time for serving a prison sentence from 30 to 40 years of imprisonment. However, this increased severity in criminal law seems to be far from solving the problem of crime. The expected little effectiveness is revealed in the criminal political failures of “fighting” delinquency, as well as the total lack of infrastructure in the Brazilian prison system, from overcrowding to the absence of minimum conditions for the prison to achieve any utopian educational purpose. The amount of the penalty does not result in the quality of the sanction imposed, but a greater retaliation by the State towards the criminal.
