Abstract

The normative production is not a complete guarantee of effectiveness of the legal text. Based on this reflection, there are several challenges to the effectiveness of Law no. 13.869/2019, entitled “Abuse of Authority Law”. The standard created 23 new criminal types, also providing for administrative and civil sanctions applied to any public agent. Despite representing an evolution and repealing the old Law no. 4.898/1965 that dealt with the subject, the current rule is already the target of seven Direct Actions of Unconstitutionality proposed by several associations of legal authorities. Therefore, in order to point out the main obstacles to the effectiveness of the new Abuse of Authority Law, this work traces an overview of the normative evolution on the subject, evaluating Law no. 4.898/1965.
