Abstract

This article analyzes the main difference between the adversarial and inquisitorial criminal systems, namely: the place of the judge. Then, it analyzes the role of the parties within the existing criminal process, in light of the changes dealt with by Law No. 13.964/19, in order to ascertain, at the end, the important role of the Public Defender’s Office in the Brazilian reality and the essential effort to achieve the fundamental objectives of the Republic fixed in art. 3rd, III, of the Constitution of the Federative Republic of Brazil.

Professor Titular de Direito Processual Penal da Universidade Federal do Paraná, aposentado. Professor do Programa de Pós-graduação em Ciência Criminais da PUCRS. Professor do Programa de Pós-graduação em Direito da Faculdade Damas, do Recife. Especialista em Filosofia do Direito (PUCPR), Mestre (UFPR); Doutor (Universidade de Roma “La Sapienza”). Presidente de Honra do Observatório da Mentalidade Inquisitória. Advogado. Membro da Comissão de Juristas do Senado Federal que elaborou o Anteprojeto de Reforma Global do CPP, hoje Projeto 156/2009-PLS.
