Abstract

This article aims to analyze the amendment promoted by Law 13.964/19, in art. 83 of the Penal Code, to obtain conditional release, namely: the "noncommitment of serious fault in the last 12 (twelve) months" (art. 83, III, "b" of the Penal Code). This is because the Superior Courts have consolidated the understanding that it is possible to evaluate the behavior of the convicted as a whole to decide on the granting of conditional release, especially if one or more serious faults have or have not been committed. Thus, the new legal amendment raises questions about the need to revise the jurisprudential understanding that did not establish a time limit to analyze the conduct of the convicted.
