Abstract

The paper seeks to point out the main characteristics of the risk society proposed by Ulrich Beck, and to identify the influences that this model of social organization has on Criminal Law, especially with regard to the problem of the creation of new supraindividual juridical assets with diffuse content, responsible for the Criminal Law expansion process. The central concern is to demonstrate that the yearnings for security in the face of new risks imply the establishment of a diametrically opposite relationship between guarantees and effectiveness, which is expressed through the thesis that the tightening of punitive laws and measures is essential to increase security citizens, even at the expense of the sacrifice of human rights and the criminal and procedural guarantees of those accused of committing crimes that endanger society as a whole.
