Abstract

The paper analyzes the “Inquisitorial Sabotage Movement (ISM)” faced with the adoption of the Adversarial System by the Criminal Procedure Code starting from Law 13,649/19. It aims to demonstrate the importance of the legislative innovations of the referred Law in the scope of the criminal process for the realization of a procedural democracy, as well as the difficulties in its accomplishment in face of the inquisitive and authoritarian mentality still latent in the judicial.
