Legality and the application of the non-prosecution agreement in ongoing cases

Abstract

Legality, understood as a guiding principle of Substantive Criminal Law and Procedural Criminal Law, has been subject to tension in which it is currently coerced. The observance of this principle assumes an essential role in the process of mitigating arbitrariness committed by the judges within the spectrum of a democratic and accusatory criminal process. The issue faced assumes a leading role as to the limits of legality in view of the massive logic of criminal negotiation. The Anti-crime Package, within this negotiation dynamic, foresaw the Non-Prosecution Agreement (NPA) as a new criminal proceedings pratice within the Criminal Procedure. Therefore, this article aims to question dogmatically, through bibliographic research, the applicability of NPA in ongoing criminal proceedings
