this paper seeks to understand how the Brazilian Supreme Federal Court jurisprudence was modified to enable the immunity from jurisdiction to be disregarded in case state’s public or governmental acts violate human rights. For this, the jurisprudential topic nº 944 was chosen for a case study for the reason that it is since its ruling that Supreme Federal Court’s jurisprudence is changed. Bourdieu's Sociology of the Legal Field is utilized to understand this phenomenon. It is sought, then, to comprehend how the symbolic capital is mobilized by the justices to justify their rulings: doctrines, jurisprudence and cited laws, for example. To change the jurisprudence, Justice Edson Fachin needed to mobilize more symbolic capital than the others, using a symbolic capital much more internationalized. On the other hand, the new jurisprudence points in the sense that a handful of justices was already intending towards this change, culminating in this enunciative act. Besides, the Human Rights application sought to justify the not applying the jurisdictional immunity could indicate some sort of internal contradiction of the legal form to be solved by them.
