Abstract

Law 13.964/19 expanded the scope of the already known consensual criminal law. With greater scope than the criminal trasaction and the conditional suspension of the process, it joined them and brought to the field of the possibility of composition most of the typical criminal conduct. Several themes of the new legal provision deserve to be highlighted in these first readings and certainly will still be the subject of much doctrinal and jurisprudential debate. In this paper we seek to present the situation of consensual criminal law in Brazil, to address principiological issues, to review the hypotheses of appropriateness and to problematize them in view of the characteristics and harmony of the crimianl procedural system, as well as to address the problem of accusatory excess in relation to the subject.
