Of the (im)precisibility of the periculum in mora for the enactment of property precautionary measures in financial crimes

Abstract

The periculum in mora is one of the requirements for the enactment of precautionary measures of property in criminal proceedings, linked to the risk of being able to satisfy the effectiveness of the compensation for the damage caused by the crime, due to the delay in the judicial provision. In order to verify his presence, the prosecution must demonstrate that the defendant is carrying out acts that may lead to a reduction in his assets, capable of jeopardizing any compensation. Based on this element, the present study examined the recent jurisprudence of the Federal Regional Court of the 4th Region on the subject, in order to identify whether there is a requirement to demonstrate the periculum in mora for the enactment of patrimonial assurance measures. As a result, the existence of an automatic presumption of periculum in mora was found in the examined precedents, without a deepening of the elements of the specific case. In conclusion, the article discusses the violations of criminal procedural guarantees resulting from this positioning, such as the prevention requirement of the precautionary measures, the state of innocence, the principle of proportionality and the need to motivate judicial decisions.
