Abstract

The bail hearing was implemented in Brazil in 2015, at the initiative of the National Council of Justice. However, only recently, after Act No. 13.964/2019, it was incorporated into the Criminal Procedure Code. This article aims to portray the context in which this instrument was inserted in the Brazilian legal system, as well as its objectives and procedure. The changes brought by the so-called Anticrime Act are presented, questioning, especially, the new writing of article 287 of the Criminal Procedure Code and the possibility of providing the hearing for some types of prison, as well as the (un)constitutionality of § 2 of article 310 of the same diploma, and the impossibility of provisional freedom for some cases.
